Terms and Conditions for the “Are You Listening?” Contest
1. Introduction
1.1. These terms and conditions (the “Terms and Conditions”) apply to the “Are You Listening?” contest (the “Contest”) conducted by MDLBEAST Radio (the “Announcer”).
1.2. By participating in the Contest, all entrants agree to abide by these Terms and Conditions.
2. Contest Period
2.1. The Contest will run from July 1, 2024, to July 21, 2024 (the “Contest Period”).
3. Eligibility
3.1. The Contest is open to all residents of Saudi Arabia aged 18 years and above.
3.2. Employees of MDLBEAST, their immediate families, and anyone else professionally connected with the Contest are not eligible to participate.
4. How to Enter
4.1. Listeners need to listen to MDLBEAST Radio during the Contest Period and wait for the special cue: “Are you listening?” (the “Special Cue”).
4.2. When the Special Cue is heard, participants must send a Direct Message (“DM”) to the MDLBEAST Radio Instagram account (@MDLBEASTRadio).
4.3. All those who complete filling out their entry and submitting their details via a DM within the first 5 minutes of the Special Cue playing will be entered into a draw for a grand prize of SAR 100,000, which will be awarded at the end of the Contest on July 21, 2024.
5. Prize Details
5.1. Instant Cash Prizes:
5.1.1. All participants who send a DM within the first 5 minutes after the Special Cue will be entered into a draw for the grand prize of SAR 100,000. (Ref 8.4)
6. Winner Selection
6.1. Grand Prize Draw:
6.1.1. On July 21, 2024, all participants who qualified by sending a DM within the first 5 minutes of the Special Cue will be entered into the grand prize draw.
6.1.2. The draw will be conducted at a specified time, and the shortlisted candidates will be contacted by phone.
6.1.3. The first candidate to answer their phone with the phrase, “I listen to MDLBEAST Radio,” will win the SAR 100,000 grand prize.
6.1.4. If a candidate does not answer with the phrase, another candidate will be selected until a winner is determined.
7. Notification of Winners
7.1. Instant cash prize winners will be notified via Instagram DM.
7.2. The grand prize winner will be announced on air and contacted by phone.
8. Prize Conditions
8.1. All prizes are non-transferable and non-exchangeable.
8.2. MDLBEAST Radio reserves the right to substitute any prize with another of equivalent value without giving notice.
8.3. Winners are responsible for any taxes payable as a result of a prize being awarded or received.
8.4. Eligible instant cash prize and grand prize winners will receive their prizes within 6 weeks of winning.
9. General
9.1. MDLBEAST Radio reserves the right to amend these Terms and Conditions at any time without prior notice.
9.2. MDLBEAST Radio reserves the right to disqualify any participant who breaches these Terms and Conditions or engages in any unlawful or improper conduct calculated to jeopardize the fair and proper conduct of the Contest.
9.3. MDLBEAST Radio’s decision on all matters relating to the Contest is final and no correspondence will be entered into.
10. Limitation of Liability
10.1. MDLBEAST Radio accepts no responsibility for any damage, loss, injury, or disappointment suffered by any participant as a result of entering the Contest or accepting any prize.
10.2. MDLBEAST Radio is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received on account of technical problems or traffic congestion on the internet, telephone lines, or any website, or any combination thereof, including any injury or damage to participants or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the Contest.
10.3. MDLBEAST Radio will not be responsible for any actions taken by participants that may endanger lives or pose risks to their safety or the safety of others while participating in the contest.
11. Governing Law
11.1. These Terms and Conditions are governed by the laws of Saudi Arabia.
12. General Terms and Conditions
12.1. These Terms and Conditions apply to all competitions announced by MDLBEAST Radio and its group companies (the “Competitions”). Each of the Competitions will have its specific terms and conditions such as entry details, opening/closing dates, and the type of prize you may receive (the “Specific Terms”). In case of any conflict between the Specific Terms and these Terms and Conditions, the Specific Terms will prevail.
12.2. MDLBEAST Radio may change the Specific terms of each competition, as well as these general terms and conditions for the competition at any time. Participants must regularly check MDLBEAST Radio’s website for any changes that will take effect from the date they are uploaded on the site.
12.3. By entering any competition, the participant agrees to comply with these general terms and any applicable Specific Terms.
13. Organizer Identity
13.1. Unless otherwise stated in any Specific Terms, the organizer of this competition is MDLBEAST Radio or one of its affiliated companies. If the organizer is another party, the terms “we” and “us” will refer to both MDLBEAST Radio and the announcing party.
13.2. MDLBEAST Radio is a company registered in Riyadh, Saudi Arabia. Its registered office is located at 2311, East 17 Dhahrat Al Awudah District, Postal Code 13732, Diriyah, Kingdom of Saudi Arabia. If there is any need related to any of MDLBEAST Radio’s competitions, anyone can send an email (radio@mdlbeast.com), clearly mentioning the competition name and the subject of the inquiry or complaint.
14. Eligibility Rules for Competitions
14.1. When participants are required to sign a waiver or any document before participating in any competition, and if the participant is under 18 years of age, that document must be signed by the participant’s parent or legal guardian before entering the competition.
14.2. The minimum and maximum age requirements for participants will be specified in the Specific Terms of any competition.
14.3. Specific competitions may have special eligibility requirements, such as providing a valid passport, residency visa, driving license, proof of physical fitness, etc. The special eligibility requirements will be defined in the Specific Terms of any competition.
14.4. The decision regarding whether the eligibility requirements are met or not is our absolute decision, and we may request proof or evidence from participants before awarding prizes.
14.5. MDLBEAST employees or their second-degree family members (siblings, grandparents, grandchildren, and those of similar kinship) are not eligible to participate in any competition. Likewise, employees of third-party prize providers or their second-degree family members are also not eligible to participate in any competition.
14.6. A participant under the age of eighteen (18) must obtain parental or legal guardian consent (and provide MDLBEAST with details of that consent if desired for verification). The parent or legal guardian must represent the minor in all competition-related actions that the minor cannot legally undertake themselves. Otherwise, MDLBEAST will have the right to disqualify the unrepresented minor from the competition or, in the case of winning, withdraw the prize if the parent or legal guardian retracts their representation. The participant acknowledges that MDLBEAST is not obliged to accept the participation or deliver any prize to any minor participant unless the necessary legal documents proving the correct representation of the minor by their parent or legal guardian are provided.
15. Registration and Entry Methods
15.1. Additional Charges: Participation in the competition may be via premium-rate landline calls or mobile calls or messages or via social media channels. The network provider of the participant may impose different rates for this type of call or data usage, which may result in a higher cost than MDLBEAST Radio mentions. In all cases, the participant should check this with their network provider. They should also be aware that improper or unsuccessful entries made through these methods may also incur a cost. Additionally, they must always obtain permission from the bill payer before making a premium-rate call. When entry is via telephone, entries made before the lines open or after they close will not be counted in the competition, but MDLBEAST Radio cannot guarantee that no charge will be imposed on such calls or messages.
15.2. Entry via Telephone: When entry in the competition is via telephone, the competition lines will open and close at the times specified in the Specific Terms. To be valid, entries must be received after the opening time and before the closing time. Entries made before the opening time or after the closing time will not be counted in the competition, but this does not mean that MDLBEAST Radio can guarantee that no charge will be imposed on such calls or messages.
15.3. Entry via Social Media Channels: When entry in the competition is via sending a message via Social Media Channels, the participant will need a mobile phone that supports data with an account with the network. Social Media entries are considered received when they enter MDLBEAST Radio’s database, not when they leave the participant’s device. Messages must be sent to the correct account and must contain the correct keywords or answer format specified in the competition. Entries that do not meet these requirements will be void.
15.4. Invalid Entries: In all competitions, MDLBEAST Radio reserves the right to reject any entries that are illegible, incomplete, incomprehensible, damaged, or otherwise invalid. MDLBEAST Radio also reserves the right to reject entries that are illegal, inappropriate, racist, inflammatory, or defamatory, or that it believes otherwise damage its reputation and brand. MDLBEAST Radio is not responsible for any late, lost, or incorrectly sent entries, including, but not limited to, social media, SMS, calls, or emails not received due to technical faults, network congestion, or any other reason. Proof of sending any entry by post does not constitute proof of receipt.
15.5. Automated Entries: The use of any automated entry software or any other mechanical or electrical means that allows a person to repeatedly enter any competition is prohibited.
15.6. Names: Participants must enter competitions using their legal names. MDLBEAST Radio reserves the right to disqualify any entry that uses multiple names and to request that they return any prizes they may win.
15.7. Multiple Entries: Unless otherwise permitted under any Specific Terms, no person may enter any competition more than once, nor may persons enter or participate as syndicates or on behalf of any other person or syndicate or group or company.
15.8. Retrospective Action: If it is discovered that any participant or winner has breached any of the competition terms and conditions, or if it is discovered that any person has breached any of the entry restrictions specified in clauses to above in particular, MDLBEAST Radio may exercise its right to disqualify that person and request that they return or reimburse any prize, even if the prize has been awarded and/or delivered.
16. Prizes
16.1. MDLBEAST Radio reserves the right in all cases to replace the prizes mentioned with prizes that it considers generally of equivalent value. MDLBEAST Radio also reserves the right to replace the prizes mentioned with cash amounts. In either case, the winner must accept the prize as presented. If a person under the age of eighteen wins a prize, all these terms and conditions and the specific terms and conditions of the competition must be signed by the winner’s parent or legal guardian before the prize is awarded. MDLBEAST Radio reserves the right to present the prize to the winner’s parent or legal guardian on behalf of the winner.
16.2. When participants or winners are required to sign a waiver or any other document before the prize is awarded, MDLBEAST Radio has the right not to deliver the prize if the document is not signed, and if the participant or winner is under eighteen, that document must be signed by the winner’s parent or legal guardian before the prize is awarded.
16.3. All winners will be notified of their win via telephone or in writing or by the method specified in the competition’s Specific Terms.
16.4. Each winner receives their prize according to the mechanism and location specified in the competition’s Specific Terms. MDLBEAST Radio is not responsible for any prizes lost, damaged, or delayed due to reasons beyond its control.
16.5. MDLBEAST Radio reserves the right to request proof of the winner’s identity, age, and address. If the winner cannot provide proof of their identity and age reasonably, MDLBEAST Radio may withdraw the prize from them and select another winner. If the winner wants another person to collect the prize on their behalf, they must provide all necessary legal documents and sign any documents requested by MDLBEAST Radio.
16.6. MDLBEAST Radio reserves the right to disqualify participants from entering its competitions or winners from receiving their prizes if any person behaves in an unsafe, illegal, unsocial, or inappropriate manner.
16.7. All prizes are non-transferable and non-exchangeable unless otherwise decided by MDLBEAST Radio at its sole discretion as outlined above. For prizes that include admission tickets or attendance at events or holidays and similar time-limited benefits, they must be taken on the dates specified in the relevant Specific Terms. If the winner does not take any part of the prize at the specified time by MDLBEAST Radio (or by any relevant third-party prize provider), that part of the prize is forfeited by the winner. No cash alternative is provided for the prize or any part of it.
16.8. The winner is responsible for any taxes payable due to the awarding or delivery of a prize. The winner should seek independent financial advice if this is a concern for them unless MDLBEAST Radio agrees and confirms otherwise in writing.
16.9. MDLBEAST Radio makes no representation or warranty regarding the prizes provided, and to the fullest extent permitted by law, it accepts no liability to participants regarding any prize or its suitability or fitness for purpose.
16.10. MDLBEAST Radio is not responsible for any fluctuations in prize values. Cash prizes are awarded by check or bank transfer in the winner’s name. Making any other arrangements is at MDLBEAST Radio’s sole discretion.
16.11. There are no additional costs or expenses on any prize unless otherwise stated. For example, the prize does not include transportation costs to and from a specific location or event, and if the prize includes accommodation, it only covers basic accommodation costs unless specified otherwise in the competition’s Specific Terms.
By participating in the Contest, you agree that you have read, understood, and accepted these Terms and Conditions.
